To the maximum extent permitted by law, My Simple Agent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use or inability to use the service. Our total liability shall not exceed the total amount you have paid us for the service.
My Simple Agent shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, strikes, power outages, internet or telecommunications failures, failures of third-party service providers (including but not limited to cloud hosting, telephony, and payment processors), cyberattacks, government actions, or any other force majeure event. During such events, our obligations under these terms shall be suspended without liability.

We are not responsible for the availability, accuracy, or performance of these third-party services. Any outages, errors, or issues caused by third-party providers are not the responsibility of My Simple Agent. Your use of the service constitutes acceptance of the terms and policies of these third-party providers.
You expressly understand and agree that your use of the service is at your sole risk. You assume full responsibility for all risks associated with the use of the service, including but not limited to: reliance on AI-generated responses, potential loss of business opportunities, customer dissatisfaction, reputational harm, or any other damages arising from the use or inability to use the service. You acknowledge that AI technology is inherently imperfect and may produce errors, inaccuracies, or inappropriate responses.
Any feedback, suggestions, ideas, or other submissions you provide to us regarding the service shall become our exclusive property. You hereby assign all rights, title, and interest in such feedback to My Simple Agent. We shall be entitled to use, reproduce, disclose, publish, and distribute such feedback for any purpose without restriction or compensation to you.
You agree that any claim or cause of action arising out of or related to your use of the service or these Terms of Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This limitation applies to the fullest extent permitted by law.
You may not assign or transfer these Terms of Service or any rights or obligations hereunder without our prior written consent. By using our service, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You agree to keep your contact information current and to monitor your email for communications from us.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and My Simple Agent regarding the use of our service and supersede all prior agreements and understandings.
